AGREEMENT
TERMS OF PAYMENT
40% of the total rental price is required as a deposit, and will confirm your boat rental
The remaining 60% is payable upon delivery of the boat
A refundable security deposit of 400 € is required.
1. If the weather conditions do not allow a boat trip, you will be offered an alternative date. If this 2nd date does not suit you, we will return your deposit.
2. Your security deposit can be paid at the time of booking, either in cash or by credit card.
3. Upon receipt of the boat and all equipment at the home port, in the same condition as you accepted it, the security deposit, less the cost of fuel consumed, and late penalties where applicable, will be refunded.
OBLIGATORY EXTRAS
We will charge for fuel consumption according to the price per litre, (as per rental contract), upon handover of the vessel, and will deduct the payment of same from the security deposit, upon your return.

CONDITIONS
Minimum age of children permitted on board is 3 years.
Children under the age of 12 are required to wear life jackets on board.
The lessee shall return the boat to the docking area provided at the base port, free of litter, and in the same condition as when received.
Where the lessee fails to return the boat accordingly, the lessee will be charged for transfer of the vessel to home port, and any related costs. These charges/costs will be deducted from the security deposit.
Replacement cost of lost or damaged items / accessories such as anchors, mattresses, awnings, refrigerators, etc., will be deducted directly from the security deposit.
Where the value of the lost or damaged items exceeds the security deposit amount, we will issue an invoice with 7 day terms of payment.
The lessee is liable for all damage (normal wear and tear excepted), caused to the boat during the rental period. Daydream boats Ibiza may retain part or all of the security deposit, as necessary, to cover the cost of repairs.
Where such costs exceed the amount of the security deposit, Daydream boats Ibiza will charge the lessee the full amount of same, including reasonable collection and legal costs, where applicable.
LATE RETURN
If the lessee returns the boat to the dock more than 30 minutes after the contractually agreed time, the lessee forfeits 50% of the security deposit.
CANCELLATION
In the event of cancellation by the lessee, for any reason, the following charges will apply:
Cancellation 24 hours prior to confirmed date - 50% of deposit.
Cancellation within 24 hours of confirmed date - 100% of deposit.
PROHIBITED ACTIVITIES
During the operation of the vessel, the lessee may not violate any of the following rules and regulations:
The skipper is prohibited from consuming alcohol or using any illegal substance.
Pets are not permitted on board the vessel.
The vessel may only dock at the designated docking area, except in case of emergency.
DAYDREAM BOATS IBIZA reserves the right to prohibit customers from entering the vessel at any time.
UNSAFE USE
The lessee must be present at all times during the lease period of the vessel.
The lessee must ensure that there are no more people on the boat, than are contractually permitted.
If at any time the lessor deems that the lessee is using the vessel improperly or dangerously, the lessor or his representative, may notify the lessee cancelling the leasing agreement, effective immediately, and at his/her discretion, board and take possession of the vessel. The lessor has the right of determination, as to whether a behaviour is improper or dangerous.
If the lease is cancelled due to improper or dangerous use, the security deposit is forfeited.
Any breach of the above conditions, will result in the loss of security deposit and/or initiation of legal proceedings.
By signing the contract, the lessee confirms that he/she has read and understood all the provisions and rules explained as above, and that he/she agrees to abide by the same.
DISCLAIMER – ACCEPTANCE OF RISK
The lessee acknowledges that the activities for which the vessel is designed, involve inherent dangers, including the risk of bodily injury and/or death.
By signing the rental agreement, the Lessee expressly accepts all risks associated with the use of the boat.
